A. All dogs and cats shall be spayed or neutered prior to adoption. Dogs and cats eligible for adoption may be spayed or neutered at the expense of the Borough. It is a violation of this section for an adoptive owner to possess an adopted dog or cat that is not spayed or neutered.

B. No animal may be adopted that is in an unhealthy condition as determined by a licensed veterinarian, unless the condition is manageable or the animal is placed under the care of a licensed veterinarian.

C. Adopting an animal from the animal shelter is a privilege, not a right. Animal control may refuse to adopt an animal to a person if:

1. The person is under the age of majority; or

2. The person has identified a factor that conflicts with their ability to provide humane care and control of an animal with special needs as identified by animal control such as an animal that is fearful or aggressive towards children or other specific animal species; or

3. The person has a history with the animal shelter on two or more occasions of euthanizing animals with no valid medical or behavioral problems as determined by a licensed veterinarian. (Ord. 2019-09 § 2, 2019; Ord. 2017-27 § 6, 2017.)
