20.16.100 Use agreements on Borough land.
A. “Use agreement” means an agreement granting exclusive or nonexclusive use of Borough land for noncontinuous periods of time pursuant to a schedule or other terms specified in the agreement, but excluding mobile concession uses. Noncontinuous periods are consecutive periods of time not to exceed six months.
B. A person seeking exclusive or nonexclusive use of Borough land for noncontinuous periods of time may apply to the Mayor for a use agreement. The applicant shall pay to the Borough the use agreement fees as required by the established user fee schedule. A use agreement may contain a provision allowing for its renewal. Use agreements are revocable without cause and shall not allow for the construction of permanent improvements on Borough land. (Ord. 2019-03 § 4, 2019.)
