A. For a proposed service area or annexation ordinance initiated by a petition, the Assembly shall consider the proposal in light of the Mayor’s review and recommendations. There shall be a presumption of appropriateness of the proposed boundaries. Should the Assembly make a finding that the proposed boundaries are inappropriate, it shall return the ordinance to the Borough Mayor for modification and further investigation.

B. If an ordinance is introduced by an Assembly member or the Mayor that provides for a service area election for a proposed service area or annexation, a staff report shall be prepared at least five days prior to public hearing and posted on the Borough’s website with the information on the election. The staff report shall include at least the following information:

1. The approximate number of parcels and the taxable assessed value of the parcels to be included in the service area;

2. If annexation to an existing service area, the prior year mill levy and estimated tax revenue that will be generated if the proposition is approved;

3. If establishing a new service area, an estimate by staff as to the revenue needed to provide service, including operational costs, capital costs, administrative overhead and an initial contribution to the service area fund balance, and the approximate mill levy based upon this estimate;

4. For a road service area, the name, constructed length and width and road material and condition of roads in the proposed area; the projected cost per mile to provide service; the estimated per mile tax revenue that will be generated from the annexation; and general information regarding the existing road service area;

5. For a fire service area, the estimated population within the area proposed for annexation and any relevant information on the impact on the existing service area resources; and
