A. A request for a hearing under this chapter shall be filed with the Department of Community Planning within 15 days of completion of the notice of impoundment.

B. The Mayor or a person appointed by the Mayor shall hold a hearing within 48 hours or on the next business day after receiving a request. During the hearing, both the owner and a Borough representative shall have the opportunity to present evidence, including but not limited to the presentation of witnesses, but formal rules of evidence shall not apply.

C. A decision shall be issued in writing no later than five business days following the hearing.

D. A decision under this section is appealable to superior court in the fourth judicial district as provided by court rules for administrative appeals. (Ord. 2019-08 § 2, 2019.)
